6 Legal Documents Parents Might Face in Disputes

When parents are separating or have custody disputes, they are most likely to be legally served with documents. Although understanding the legal documents at first may be quite challenging and scary, once they understand what the documents intend, it will be easier for them to make reasonable and informed decisions.

1. Parenting Plans

Parenting plans describe parental coordination on sharing of responsibilities, communication methods, and child custody duration per parent, etc. First of all, they can be very useful for children in recalling the changes, especially if they are facing divorce or other significant family changes.

2. Deposition Notices

5. Relocation Notices

A relocation notice lets one parent know that the other parent is planning to move a long distance. Probably the biggest change that moving brings is the revision of the visitation schedule, enrollment of the children in different schools, and, in general, modification of parents’ and kids’ interaction. 

Often, these notification letters do not go beyond the basic details of a move: what the move is, which schools the children might be going to, how they are going to get there, and methods of communication. But all of these details actually give judges a big picture of whether relocating will be in children’s best interests. 

6. Custody Evaluation Reports

A custody evaluation report is a document that summarizes the main findings from interviews, home visits, and tests. They provide judges with a more detailed understanding of the qualities of both parents and how well they can take care of the children, to name a few things. 

For example, evaluators are looking for communication styles, daily routines, parental support with education, and emotional support levels to be considered. The court gets a clear and fair picture of both parents, which later helps decide whether the children have to be with one or both parents on a temporary or permanent basis. 

In many cases, a parent may go through the report before the hearing. Sometimes, parents need to prepare a thorough explanation or additional documents when certain items in the report need to be brought up to date or explained more clearly. 

Reports address issues such as the physical home’s arrangement, involvement in school and extracurricular activities, parents’ cooperation with the court-ordered schedule, and the emotional support they provide to children. The court relies on school attendance and academic results, doctors’ and health records, and therapy records to weigh against the evaluation report so that the judgment can be made from an informed position of the whole family situation.
